1. GENERAL PROVISIONS
The website www.natural-elements.net is owned by Natural Elements Ltd.
for the manufacture of pharmaceutical preparations (hereinafter referred to as
Natural Elements Ltd.). Natural Elements Ltd. allows the use of the services
and content of this Website governed by these Terms of Purchase.
The terms of purchase prescribe the terms and conditions for end
users and apply to the use of this website. By using the Website, end users
agree to be bound by the General Terms and Conditions of Purchase and agree to
use the Website in accordance with them.
Access to these websites may sometimes be inaccessible due to the
work, maintenance or introduction of new content and in cases of unforeseen
circumstances beyond the control of Natural Elements Ltd., which we will
endeavor to eliminate as soon as possible.
All material on this site is the exclusive intellectual property
of Natural Elements Ltd. and may only be used with the express permission of
the copyright and trademark and / or design rights holders.
The user may submit their queries and comments in writing, by mail
or e-mail, and Natural Elements Ltd. will send a written response by mail or
e-mail within the legal deadline.
2. BASIC TERMS
For the purposes of these Terms of Purchase, the buyer is a
natural or legal person who orders at least one product, fills in the required
information and pays for the ordered product through this website.
If the information on the buyer contains information about the
legal entity, then the buyer is considered a legal entity, and the natural
person whose data is entered is considered the authorized person of the buyer.
PERSONAL DATA AND BUSINESS ABILITY
For a valid product order, the person completing the order must be
over 18 years of age.
The buyer is responsible for the accuracy and completeness of the
information entered during registration.
Natural Elements Ltd. reserves the right to change these Terms of
Purchase and may change them without notice, but undertakes to notify all
registered users by the e-mail addresses they have entered at registration.
Any changes you make will apply to the use of these websites.
PRICE
Natural Elements Ltd. undertakes to prominently and
legibly state the amount of the retail price in accordance with Article 7 of
the Consumer Protection Act (OG 41/14). All prices are in Croatian national
currency, Croatian kuna (kn), VAT included. Payment and interbank transaction
costs are not included in the price.
Natural Elements Ltd. shall periodically, in accordance with its
decision, place certain products on special sale at a price lower than the
price of those products in regular sale, and undertakes to clearly, visibly and
legibly mark and indicate the length of the sale of promotional sale.
After the expiration of the special offer, Natural Elements Ltd. will
not receive orders on terms relating to expired stock sales.
The prices of all products are informative and subject to change
without notice.
PRODUCT INFORMATION AND AVAILABILITY OF PRODUCTS
The product data on this site is made according to the database of
the company Natural Elements Ltd..
Photos of the product are symbolic and informative in nature and
do not necessarily correspond in all details to the products being ordered.
Natural Elements Ltd. points out in particular that the visual identity of the
product shown in the photo may not correspond to the product's appearance in
reality, especially given the monitor settings on the customer's computer,
given the differences in color perception of how the customer sees them on the
screen, etc.
In the case of the above discrepancy between the product shown in
the photograph and the product supplied, this is not a defect in the product.
Product data (product description, pricing, etc.) displayed on
this site are subject to malfunctions and irregularities in the application,
other technical irregularities, typographical errors, etc. In the case of
obvious errors or malfunctions regarding the product data displayed on this website
page, Natural Elements Ltd. reserves the right to terminate the contract
unilaterally.
Only products for which an order is indicated to be available in
stock may be subject to order.
In the event that multiple users are ordering on this site at the
same time, it may be that the product availability information is not identical
to that of Natural Elements Ltd. warehouse.
If the product ordered is not available in stock, Natural Elements
Ltd. will inform the buyer that the product is currently unavailable, the time
limit within which the product is available, and at the same time offer the
possibility to buy an alternative product from the offer, which is available
for delivery and which in its characteristics is closest to the ordered product,
which is not available.
3. BUYING ON THE WEB SHOP
By selecting each product around it are written the details - the name of the
product, a short description, price, quantity and whether it is available by
clicking on the "Shopping Cart" button for each item are listed in the
"Shopping Cart".
The prices shown on the pages next to each product are expressed
with VAT already included.
By accessing the Shopping Cart menu, the customer gets an insight
into the selected products, their quantity and price.
The product included in the Shopping Cart is purchased by clicking
the "Finish Purchase" button.
For each order, the shipping price is indicated below the cart.
After clicking on the "Finish Purchase" button, the
buyer enters the order form in which you are obliged to enter personal
information.
After receiving all the required information from the order, a
message will be displayed on the screen that the buyer's order has been
received and the buyer will receive a special notification electronically by
e-mail to the indicated email address.
4. ORDER AND CURRENT TIME OF CONCLUSION
Products are ordered by selecting, using the menu and filling out
an electronic form. The product is considered to have been ordered when the
customer has completed the entire ordering process. The order is considered to
be received at the time when Natural Elements Ltd. through the website,
electronically receive the order.
At the time the order was received, Natural Elements Ltd. will
notify the buyer electronically by e-mail that the order has been received or
that the product has been successfully ordered. If the buyer does not receive
the notification from the previous paragraph, it is suggested to check:
The contract is considered concluded at the time when Natural Elements d.o.o. receive confirmation that the order amount has been paid.
If the product is ordered and Internet banking, bank transfer or
general payment slip is selected as payment method, Natural Elements Ltd. agrees
to reserve the product in stock for 3 working days, not including Saturday.
After 3 business days of receiving the order, Natural Elements Ltd. does not
guarantee product availability.
5. PAYMENT

By selecting card payments, clicking on the "Payment
method" menu automatically opens a separate window into which all the
requested information is entered. If you choose to pay via Internet banking or
a general payment slip, we will send you an offer by e-mail upon completion of
your order. You can pay the offer according to your pre-selected payment
method.
If payment is made and Natural Elements Ltd. does not dispose of
the ordered product due to lack of goods in stock, the buyer will be notified
within a reasonable time, and Natural Elements Ltd. make a cash back payment.
In the case of the payment above, the buyer shall be liable and
bear the risk of the accuracy and veracity of the information provided since
Natural Elements Ltd. make a refund in accordance with the information
provided.
When choosing a payment method for online banking or general money
order / payment, we only pack and ship the goods upon receipt of payment. If we
do not receive your payment within the next 3 business days, we will consider
that you have canceled your purchase.
We ship the order invoice along with the goods.
6. USE OF COUPONS AND DISCOUNTS
All subscribers to the mailing list and Facebook friends of
Facebook page owned by Natural Elements Ltd. are occasionally presented with a
coupon for special promotions, benefits and discounts. Coupons can also be
shared in conjunction with various media, other digital networks.
A coupon is usually one word or a series of characters. To
calculate the discount in the CODE box, enter the correct text and / or
characters on the coupon, confirm it - and the discount will be automatically
calculated. The coupon enrollment box is located in the "Shopping Cart" in
the second and third steps of the payment process. Coupon benefits must be
redeemed before your purchase is completed.
Coupons may be limited by the duration and number of uses. Also
discounts can be applied to only one product, to a limited product selection or
action. All discount rules will be clearly indicated when submitting coupons.
7.DELIVERY
Products can be ordered for delivery within the territory of the Republic of Croatia, under the conditions applicable to each delivery area. Delivery in the territory of the Republic of Croatia is carried out through the delivery service selected by Natural Elements Ltd. The price of the product includes packaging and delivery. For other countries, shipping is 9.90 €.
Delivery is made in accordance with the terms of use of the
delivery service and is considered to have been made at the time of delivery of
the product to the delivery service.
TIME OF DELIVERY
All orders are shipped from Monday to Friday between 08:00 and
16:00. The maximum delivery time is 2 working days or 48 hours, except for the
islands, from the moment of order or payment received, according to the chosen
payment model. Delivery to the islands is made according to the schedule of
delivery service, and may take longer than the above.
For orders received up to 1pm on a business day and for which
payment is made to one of the debit or credit cards offered, we deliver the
goods ordered to the delivery service on the same day. If you receive your
order after 1pm on a working day, we will deliver the ordered goods to the
delivery service the next business day.
In case of payment by internet banking, general payment slip or
bank transfer, we send the order upon receipt of the payment confirmation. By
e-mail / fax the payment confirmation received by 1 pm on the working day, the
goods ordered will be delivered the same day to the delivery service. In case
of receipt of payment confirmation after 13 hours on business days, we will
deliver the ordered goods to the delivery service the next business day.
We are committed to delivering your order in a timely manner,
provided you have filled out your information in the correct and true way.
When Natural Elements Ltd. deliver the product via the delivery
service to the buyer or consignee;
DELIVERY FAILED / UNKNOWN ADDRESS
In case you are not at home at the time of the agreed delivery,
the courier will call you and arrange a new delivery date with you. Please let
us know on +385 91 9263 463 if you are not able to place an order at an earlier
appointment.
If the recipient does not exist at the specified address or the
address is unknown, the shipper will attempt to contact the recipient and
arrange a time and possibly another delivery address.
In case of failure to deliver, the shipment is returned to Natural
Elements Ltd. and the buyer will be notified by e-mail and will be offered the
following option:
If the buyer does not reply to the e-mail sent to him within 3
days and chooses one of the offered options, he will be considered to have
canceled the purchase.
In case the buyer orders the goods and refuses to receive them,
Natural Elements Ltd. has the right to deduct from the paid purchase price the
amount in the amount of shipping costs and other handling costs from the
shipping price list.
8. MATERIAL FAILURES OF DELIVERY
Natural Elements Ltd. is responsible for the material defects of
the things he sells on his site in accordance with the positive regulations of
the Republic of Croatia, in particular the Law on Obligations.
The products ordered are packaged in such a way that they are not
damaged by the usual handling / shipping manipulation.
If the shipment is damaged during transport, such damage is
visible when picking up the shipment, in which case we suggest that the
shipment is not picked up by the buyer. We ask customers to contact us so that
we can check the shipment status and send a new one as soon as possible.
In the event of a noticeable defect in the product when picking up
the shipment, the buyer is not obliged to pick up the shipped product, may
refuse receipt, and shall not bear the cost of shipping such product. Products
that were duly received by the buyer were considered to have no discernible
defect.
Upon receipt of the goods, the check of the order depends on the
buyer, and the buyer is obliged to compare the received items with the invoice,
if something is missing, he must, within eight days, submit a written complaint
to Natural Elements Ltd. as subsequent complaints will not be considered.
By denying receipt, the delivery service will return the shipment
to Natural Elements Ltd., noting that the shipment contains a defect.
If the product has a hidden defect (the defect that could not be
detected by a normal inspection when picking up the item) that the buyer
identifies upon opening the product - the buyer is entitled to unilateral
termination of the contract and refund, replacement of the product, elimination
of the defect or reduction of the price.
9. WRITTEN COMPLAINTS, REFUNDS, CLAIMS, REPLACEMENT
In case the customer is dissatisfied for any reason, he / she can
file a written complaint within the legal period of 14 days from the receipt of
the shipment, by e-mail to: info@natural-elements.net, by mail to: Natural
Elements d.o.o., Bilogorska 23, 51000 Rijeka, Croatia or through an online form to
unilaterally terminate a product purchase agreement.
The buyer is entitled to a justified complaint and to return the
goods in the following cases:
In order to determine as quickly as possible the specific order to
which the buyer objects, the complaint asks customers to indicate the order
number, account number or their username. Natural Elements Ltd. will
acknowledge receipt of the complaint in writing without delay and respond
within the time limit set by the Consumer Protection Act.
In the event of a justified complaint, the buyer is entitled to
terminate the contract with a refund of the amount paid or a replacement for
the correct, undamaged and valid product.
Natural Elements Ltd. shall accept the return of damaged,
defective or incorrectly delivered goods at its own expense if the complaint is
found to be justified and the buyer has not affected the correctness, damage or
any defect of the goods.
The goods will be taken over by Natural Elements Ltd. or its
contract logistics partner, at the address to which it was shipped or at
another address, by prior agreement with the customer.
The buyer is obliged to hand over the goods to Natural Elements Ltd.
without undue delay, and in any case no later than 14 days from the date on
which he made his decision to unilaterally terminate the contract. The buyer
can return the goods himself to Natural Elements Ltd. at your own expense,
which should be notified in advance to Natural Elements Ltd.
Natural Elements Ltd. undertakes to make a refund of the money
received for the products in the complaint, including delivery costs, without
delay, and no later than 14 days from the date on which Natural Elements Ltd. goods
returned or after proof has been provided that the goods have been sent back.
The refund will be made in the same manner as the payment was
made. In the event that the buyer agrees otherwise to the repayment of the
amount paid, he shall not bear any costs for the refund.
10. RIGHT ONE-Sided TERMINATION OF THE CONTRACT
The buyer can unilaterally terminate the contract within 14 days
without giving reasons.
Buyer is not entitled to unilateral termination of the contract:
In order for the buyer to be entitled to unilateral termination of
this contract, he must inform his decision on unilateral termination of the
contract before the expiration of the deadline, by unambiguous statement sent
by mail, fax or e-mail, stating his name, address, telephone number or email
address.
You can electronically fill out and submit the online one-way
termination form. We will send you an acknowledgment of receipt of the notice
of unilateral termination of the contract by electronic mail without delay.
The term for unilateral termination of a 14-day contract begins
from the day on which the buyer or a third party designated by the buyer, other
than the carrier, is the goods forming the subject of the contract.
If the buyer unilaterally terminates this agreement, Natural
Elements Ltd. undertakes to make a refund of any money received, including
delivery costs, without delay, and no later than 14 days from the date on which
Natural Elements Ltd. the goods are returned or after proof has been sent that
the goods have been sent back.
The refund will be made in the same manner as the payment was
made. In the event that the buyer agrees otherwise to the repayment of the
amount paid, he shall not bear any costs for the refund.
The buyer is obliged to deliver the goods or send them to Natural
Elements Ltd. without undue delay, and in any case not later than 14 days after
the buyer has made his decision to unilaterally terminate the contract.
The direct cost of returning the goods is borne by the buyer
himself.
The buyer is responsible for any impairment of the goods resulting
from the handling of the goods, except for what was necessary to determine the
nature, characteristics and functionality of the goods.
11. APPLICATION OF CONDITIONS OF PURCHASE
By using the services of Natural Elements Ltd. online stores you
agree to these Terms of Purchase.
If you do not agree to the terms, do not use these sites or order
products through them.
This website contains information about Natural Elements Ltd.'s
products and services, and serves as an electronic retail outlet.
Natural Elements Ltd. shall not be liable for any damages arising
from the use of these websites and the use of information from these sites for
purposes that go beyond their intended purpose.
12. FINAL PROVISIONS
By accepting these Terms of Purchase, the Buyer agrees to the
terms of these Terms and agrees that they form an integral part of the
Agreement.
